1. Acceptance of terms

By requesting a quote, signing a contract, or using our website, you agree to these terms and conditions. These terms apply to all fence and deck installation, repair, and related services provided by Buffalo Fence & Deck(“Company,” “we,” or “us”).

2. Quotes and contracts

All written quotes are valid for 30 days from the date issued. Prices are fixed and itemized — the quoted price will not change unless you request changes to the project scope after signing. Work begins only after a signed contract and required deposit are received.

3. Payment terms

A deposit of 30–50% of the total project cost is required to schedule your installation date. The remaining balance is due upon project completion and walkthrough. We accept check, credit card, and approved financing. Late payments are subject to a 1.5% monthly finance charge.

4. Project timeline

Estimated start and completion dates are provided in good faith and subject to weather, permit approval timelines, and material availability. We are not liable for delays caused by factors outside our control, including severe weather, permit office delays, or utility locate hold-times.

5. Permits and approvals

We handle all required permit applications, utility locates, and HOA submissions on your behalf. Permit fees are included in your quoted price. Project timelines begin after all permits are approved — we cannot guarantee permit office processing times.

6. Site conditions and access

The customer is responsible for: providing clear site access; marking underground utilities not covered by 811 locate; removing personal property (furniture, planters, vehicles) from the work area prior to crew arrival; and disclosing known underground obstacles such as irrigation systems, drainage pipes, or buried cables.

We are not liable for damage to undisclosed underground utilities or infrastructure not marked by the 811 utility locate service.

7. Workmanship warranty

We provide a lifetime workmanship warranty on all installations. This covers defects in installation quality — including post lean, gate misalignment, and board separation — caused by our workmanship. Warranty claims must be submitted in writing to info@buffalofenceanddeck.com.

This warranty does not cover: normal weathering or fading; damage caused by vehicles, vandalism, or acts of nature (storms, flooding, fallen trees); changes in grade or drainage after installation; or damage caused by the customer or third parties.

8. Material warranties

Materials carry the respective manufacturer’s warranty (e.g., 25-year Trex composite warranty, lifetime vinyl warranty). We will assist with warranty claims submitted to manufacturers but are not responsible for manufacturer warranty decisions.

9. Cancellation

You may cancel a signed contract within 3 business days of signing for a full refund of any deposit. Cancellations after 3 business days but before work begins are subject to a restocking and administrative fee of up to 15% of the total project cost. Once materials have been ordered or work has begun, deposits are non-refundable.

10. Limitation of liability

Our total liability for any claim arising from our services is limited to the total amount paid for the specific project in dispute. We are not liable for indirect, incidental, or consequential damages including loss of use, loss of income, or property damage beyond the project site.

11. Governing law

These terms are governed by the laws of the State of New York. Any disputes shall be resolved in Erie County, New York. These terms constitute the entire agreement between you and Buffalo Fence & Deck regarding our services.
